1. Agreement/copyright

This agreement constitutes an order for wedding portrait services, including the taking of the wedding ceremony and/or bride/groom pictures, and/or reception/other wedding event pictures as agreed to by both parties: The photographer and Contracting Party (Client). It is understood that any and all rights to digital images, proofs, final or sample prints, shall remain the property of the photographer who shall retain full copyright to all images. These images may be used by the photographer for advertising, marketing, display or any other purpose thought proper by the photographer. Non-exclusive rights to use are granted to the client allowing client to make personal prints, share digital images, and otherwise use them in any personal manner. However, any use by the client of these images for financial gain, advertising, altering without permission or any other misuse or non-personal use of the images is strictly prohibited.

 

2. Unforseen Illness, injury or loss:

If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then the photographer will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client(s) agree that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re shoot and limits the photographer’s liability to the amount paid under this contract.

 

3. venue policies/building layout/interference and other limitations:

It is understood and agreed that Studio7photography is the sole professional photographer for this event and will be granted access as agreed upon by both parties for shooting without the interference of other photographers.  Any interference or disturbance by other photographers including their presence, equipment, lighting, electrical cords etc. may limit the ability of the photographer to get quality shots. In such cases, the photographer will not be held liable for missed shots or low quality shots caused by flashes, blocked views and other interference.  Furthermore, it is understood that the photographer may be limited by venue or location design/layout, restrictions, rules, lighting and/or other unforeseen limitations and any missed shots or obstructed views due to such limitations are out of the control of the photographer and therefore the photographer will not be held responsible or liable for any resulting missed or obstructed shots.

The photographer may be further limited by the cooperation of any and all guests, parties, event staff or clients themselves to get the creative and intended shots for this event. The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the church or location restrictions. In any such case or such a case as cooperation or participation is limited by the clients or other subjects themselves, the photographer will not be held liable for any resulting missed, obstructed or low quality shots.

 

4. Fee and cancellation agreement:

On signing of this agreement by both parties, the photographer will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason. If another date agreed upon by both parties is available, the full deposit will be transferred to the new agreement on the new date or may be used for any other photographic services on the part of the client and agreed upon by both parties.

The complete wedding fee of ___________ includes up to ____ hours of photography (any time spent beyond the agreed time as requested by the client will be billed at a rate of $250/hr which includes all professional subsequent professional editing and an increase in final number of images). A deposit of _________ is due at the signing of this agreement, with a final payment of ______________ due on or before the date of the event. An additional travel/hotel/expense fee of ____________ is separate from the wedding fee and will also be due on or before the date of the event. No photography will take place and no rights are granted until timely payment is made in full. Late payment fees may apply. The fee is non refundable in case of cancellation or date change by client.

I / we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I / we confirm that I / we have read the herein agreement prior to its execution and I / we are fully familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives and assigns. And, we certify that we have received a complete copy of this agreement with all blank lines completed.
